Pertaining to MnDOT Agreement No. 1057038 with the State of Minnesota providing for the roadway reconstruction of a portion of Trunk Highway 61 and Trunk Highway 5 by State contractor in conjunction with State Project No. 6221-107.

WHEREAS, the State of Minnesota, acting by and through its Commissioner of Transportation (the “State”) intends to let a contract for State Project No. 6221-107 located on Trunk Highway 61 (Arcade Avenue) from East 7th Street to 0.2 mile south of Roselawn Avenue in the City of Maplewood and on TH 5 from east end Bridge 62703 to Minnehaha Avenue in the City of St. Paul; and
WHEREAS, the Board of Water Commissioners of the City of Saint Paul (the “Board”) owns and operates certain water facilities presently located within the limits of said project; and
WHEREAS, the State has determined that the reconstruction of said project necessitates the relocation of Board water facilities and that Minnesota Statutes provide for this adjustment work to be accomplished as part of a state highway construction contract; and
WHEREAS, the State prepared Agreement No. 1057038 to provide for reimbursement of said relocation work at a cost not to exceed $385,193.48; and
WHEREAS, staff has reviewed said agreement and recommends approval; now, therefore, be it
RESOLVED, that Agreement No. 1057038 between the Board of Water Commissioners of the City of Saint Paul and the State of Minnesota pertaining to roadway reconstruction within State Project No. 6221-107 located on Trunk Highway 61 (Arcade Avenue) from East 7th Street to 0.2 mile south of Roselawn Avenue in the City of Maplewood and on TH 5 from east end Bridge 62703 to Minnehaha Avenue in the City of St. Paul is hereby approved in substantially the form submitted, and that the proper officers are hereby authorized and directed to execute said agreement on behalf of the Board, following approval of the assistant city attorney.
