Authorizing Public Works to collect fees from RDUs for garbage services to support the costs of operations and disposal and setting the 2025 late fee for delinquent garbage bills.

WHEREAS, City Ordinance Sec. 220.05 requires that each RDU pay one hundred (100) percent of the fixed costs and one hundred (100) percent of the variable costs for residential garbage services to their designated hauler; and

WHEREAS, as of April 1, 2025, the City contracts with a new residential garbage hauler, FCC Environmental, to collect materials from 90 percent of RDUs and Public Works staff collect residential garbage from 10 percent of RDUs; and

WHEREAS, to continue to offer base level service and additional service options for residential garbage in 2025, Public Works must be able to directly charge RDUs for those services; and

WHEREAS, City Ordinance Sec. 220.07 allows Public Works to collect any unpaid costs for garbage services through a special assessment under the authority of Minn. Stat. § 443.29 and the Saint Paul City Charter by the procedure outlined in Chapter 60 of the Saint Paul Administrative Code; and

WHEREAS, City Ordinance Sec. 220.07 states that failure of an RDU to make payment by the due date listed on the invoice will incur a monthly late fee of five (5) percent of the total amount due and owing; and

WHEREAS, the assessment-office previously set the rate of 5.65 percent and it’s applied on November 15; and

THEREFORE, BE IT RESOLVED, that the proper city officials are hereby authorized to directly charge RDUs for garbage services and impose a 5.65 percent late fee for any bills unpaid by November 15; and

BE IT FURTHER RESOLVED, that the Council of the City of Saint Paul does hereby adopt the change in billing and late fees for RDUs; and

BE IT FURTHER RESOLVED, that the Council of the City of Saint Paul does hereby ordain:
