Purpose of Appeal:  (See attachment in which appellant writes that he was given permission to build a fence.  While building it, an inspector stopped by and told him to stop working on it until his paperwork was reviewed.  The next day, the inspector said his office was incorrect when granting permission to build the fence.)

WHEREAS, in the matter of the Appeal of William T. Dillon to a Public Works letter denying an encroachment permit for a fence at 1401 ELEANOR AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer's recommendation is to grant the appeal as the fence will now be constructed entirely within the 1401 Eleanor Avenue property and not encroaching in the public right of way, noting the appellant will be providing a revised site plan to his inspector or the building official; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter grants the appeal allowing encroachment into the Right of Way.
