We are appealing an order to obtain a structural engineer's report for what is a minor, routine repair, and we are appealing the accompanying condemnation order.

WHEREAS, in the matter of the appeal of Brad Nilles/Calabash Properties to a Fire Certificate of Occupancy Correction Notice at 732 MARSHALL AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

WHEREAS, the Legislative Hearing Officer recommends that the City Council deny the appeal and grant an extension to October 18, 2011 to come into compliance; Now, Therefore, Be It

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
