Authorizing the proper City officials to execute and record an easement agreement for drainage purposes at the Southern Highland Bridge development site to benefit City parkland and the University of St. Thomas ballfield project.

WHEREAS, the City of St. Paul ("City") owns certain real property described as Park, Southern Highland Bridge ("City Property"); and
WHEREAS, the University of St. Thomas, UST HB, LLC ("UST") owns certain real property described as Outlot A and Lot 2, Block 1, in said Southern Highland Bridge ("UST Property"); and
WHEREAS, the City Property is being developed as a public park, Outlot A is being developed as wetland mitigation, and Lot 2, Block 1 is being developed as a ballfield, and in conjunction with such development projects the City and UST desire to establish certain easements for purposes of overland stormwater flow routes and storm drainage facilities, including but not limited to an underground drainage pipe, to benefit the City Property and UST Property and to be constructed upon certain portions of the UST Property, pursuant to the terms and conditions set forth in the Perpetual Drainage Easement and Temporary Surface Drainage Easement ("Agreement") attached hereto; now, therefore, be it
RESOLVED, that the proper city officials are hereby authorized to execute said Agreement and record same with the Ramsey County Recorder's Office and/or Registrar of Titles.
