Approving the release of slope easement rights along Rose Avenue West and Geranium Ave West, between Woodbridge Street and Rice Street.

WHEREAS, slope easements along Geranium Avenue West were recorded with Ramsey County as Document Numbers 266130 and 266131, on December 31, 1901; and
WHEREAS, slope easements along Rose Avenue West were recorded with Ramsey County as Document Numbers 415565 and 415566, on December 11, 1911; and
WHEREAS, Sean Elder of TenSquare LLC, on behalf of the Church of St. Bernard's, owner of properties located at 147 Geranium Avenue West (ID#s 25-29-23-11-0055 and 25-29-23-11-0054), 1172 Albemarle Street (ID# 25-29-23-11-0007), 0 Woodbridge Street (ID# 25-29-23-11-0114) and 0 Albemarle Street (ID# 25-29-23-11-0095) (the "Properties"), is now requesting the release of slope easements that encumber the Properties in order to facilitate redevelopment; now, therefore, be it
RESOLVED, that with the Certificate of Intended Non-Use, filed voluntarily on behalf of the City of Saint Paul ("City") Department of Public Works, the City, for itself and on behalf of said department, hereby waives, releases and terminates said slope easement rights encumbering the lots of the Properties, as depicted in Exhibit A ; and be it further
RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee, the proper City officials are hereby authorized and directed to record a copy of this resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificate of Intended Non-Use referenced in this resolution; and be it finally
RESOLVED, that all remaining slope easement rights shall remain in full force and effect and be fully incorporated into this resolution.
