Approving the Legislative Hearing Officer's recommendation for the application submitted by D X LLC (License ID# 20240001917), d/b/a Rite Liquor, for Liquor Off Sale and Tobacco Shop licenses, located at 645 Snelling Avenue South.

WHEREAS, D X LLC (License ID# 20240001917), d/b/a Rite Liquor, located at 645 Snelling Avenue S, has applied for a Class N license for Liquor Off Sale and Tobacco Shop license; and
WHEREAS, the applicant notified the Highland District Council prior to submitting their application; and
WHEREAS, a notification regarding the license application was sent from the Department of Safety and Inspections to the affected neighborhood for the period of November 22, 2024, to December 7, 2024; and
WHEREAS, during the notification period, an objection was received which triggered the hearing and a hearing was held on December 16, 2024; and
WHEREAS, the objection was related to smoking; and
WHEREAS, in response to the concerns raised, the licensee has agreed to work with the city to comply with the necessary requirements to minimize nuisance activities that would disturb the surrounding residential neighborhood; and
WHEREAS, after conducting the hearing and considering the testimonies and evidence, the Legislative Hearing Officer recommends that the application for D X LLC (License ID# 20240001917), d/b/a Rite Liquor, located at 645 Snelling Avenue S, be approved with the following conditions:
1. Licensee acknowledges that the only items permitted to be sold on the premises are those specifically authorized for an exclusive liquor store under Minnesota Statute 340A.412 Subd. 14
2. The sale of tobacco products requires an active Tobacco Shop license issued by the City of St Paul.
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license application with the aforementioned agreed-upon conditions and finds that the license conditions are reasonable, and the application is in order...
