Authorizing the Public Works Department to issue credit to Talmud Torah in the amount of $4,580.64.

WHEREAS, Talmud Torah of Saint Paul is requesting a sewer charge reimbursement from the Public Works Department for the term July 2007 - October 2009, and
WHEREAS, Talmud Torah of Saint Paul entered into a Joint Use of Playground Agreement with the City of Saint Paul on October 21, 1994; and
WHEREAS, Talmud Torah of Saint Paul provides a public benefit to the community by providing permission to the City of Saint Paul to use all of the open space playground area for recreational sports activities; and
WHEREAS, Talmud Torah of Saint Paul is the sole provider of water to maintain the open space area; and
WHEREAS, Talmud Torah of Saint Paul experienced a lapse of administrative oversight regarding the submission of Water Credit Reports; and
WHEREAS, Resolution 95-79 defines the procedures for water credit adjustments and refunds; and
WHEREAS, The Director of Public Works has made the determination that Talmud Torah of Saint Paul is unique in the fact they provide to the City of Saint Paul a public benefit by providing open space for public recreational use; and
WHEREAS, The Director of Public Works has determined the matter of Talmud Torah of Saint Paul to be very rare and the circumstances extraordinary that a variance from the one (1) year standard is warranted in this case; now, therefore be it
RESOLVED, the Public Works Department shall issue a credit for the term July 2007 - October 2009, in the amount of $4,580.64 to Talmud Torah of Saint Paul.
