Approving adverse action against all licenses held by Lee Vang, d/b/a Asian Special Drinks & Deli, 217 Como Avenue, Unit #131.
Body
WHEREAS, adverse action was taken against all licenses held by Lee Vang d/b/a Asian Special Drinks & Deli (License ID #20100002712) for the premises located at 217 Como Avenue, Unit #131 in Saint Paul by Notice of Violation dated September 30, 2011, alleging the licensee was cited for one (1) Critical-Major Environmental Health Code violation during a re-inspection of the licensed premises on September 12, 2011; and
WHEREAS, pursuant to Saint Paul Legislative Code ยง 310.05 (m) (9), the licensing office recommended a $250.00 matrix penalty and suspension of all licenses if the licensee failed to correct the violation; and
WHEREAS, the licensee did not respond to the Notice of Violation to pay the $250.00 matrix penalty and schedule a re-inspection or request a hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $250.00 matrix penalty and schedule a re-inspection or request a hearing by October 10, 2011, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, all licenses held by Lee Vang d/b/a Asian Special Drinks Deli are hereby suspended and the licensee ordered to pay a $250.00 matrix penalty for failure to correct the one (1) Critical-Major Environmental Health Code violation cited during a re-inspection of the licensed premises on September 12, 2011. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
