Appeal of John S. Jagiela to a Vacant Building Registration Notice at 134 MONTROSE PLACE.

 

Date/Time of 1st LH:  Tuesday, August 6, 2024, teleconference between 1:00 p.m. and 3:00 p.m.

Purpose of Appeal:  This is not a vacant building. The building is a triplex. I own the building and have occupied the entire 2nd Floor for more than 34 years. This is my legal residence and mailing and driver license and voting registration address.  The entire 2nd Floor and attic area is filled with my personal belongings. The tenants on the 1st Floor moved out in Nov. of 2023 and I am currently refinishing the hardwood floors and painting the 1st and ground floor units for rental upon completion of the work.

WHEREAS, in the matter of the Appeal of John S. Jagiela to a Vacant Building Registration Notice at 134 MONTROSE PLACE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

 

WHEREAS, the Legislative Hearing Officer recommends that the City Council grant the appeal and release the property from the VB program and allow occupancy of one unit on condition that the other 2 units are not rented/occupied until Fire Certificate of Occupancy is reinstated and balance of orders to be referred to Code Enforcement; Now, Therefore, Be It

 

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
