Approving adverse action against the Auto Repair Garage and Second Hand Dealer - Motor Vehicle licenses held by Phoenix Auto d/b/a 3B Auto Sales located at 1176 Dale Street North.

WHEREAS, the Auto Repair Garage and Second Hand Dealer - Motor Vehicle licenses held by Phoenix Auto d/b/a 3B Auto Sales (License ID# 20170000815) for the premises located at 1176 Dale Street North were the subject of a Notice of Intent to Revoke Licenses dated January 9, 2018; and
WHEREAS, on January 8, 2018, the Department of Safety and Inspections (DSI) received a Notice of License Revocation for Debt (“Notice”) from the Minnesota Department of Revenue; and
WHEREAS, the Notice stated that within thirty (30) days DSI must revoke the Auto Repair Garage and Second Hand Dealer-Motor Vehicles licenses held by the licensee unless DSI received a Clearance Certificate from their office; and
WHEREAS, based on that information, per Minn. Stat. § 270C.72, Subd. 1, the licensing office recommended license revocation; and
WHEREAS, on February 5, 2018, a call was made to the Minnesota Department of Revenue to inquire if a Clearance Certificate had been issued to the licensee; and
WHEREAS, according to the Minnesota Department of Revenue a Clearance Certificate had not been issued to the licensee; and
WHEREAS, the Notice of Intent to Revoke License stated that if DSI did not receive a Clearance Certificate from the Department of Revenue by February 9, 2018, that the matter would be placed on the next available consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Auto Repair Garage and Second Hand Dealer - Motor Vehicle licenses held by Phoenix Auto d/b/a 3B Auto Sales (License ID# 20170000815) for the premises located at 1176 Dale Street North are hereby revoked.
