WHEREAS, adverse action was taken against all licenses held by Mostafa H. Abdelhamid d/b/a Superstore Grocery (License ID #20090002813) for the premises located at 873 Rice Street in Saint Paul by Notice of Violation dated November 24, 2010, alleging that on September 1, 2010, a clerk inside the establishment was cited by Saint Paul Police for Selling Tobacco to a Minor in the form of single cigarettes in violation of Saint Paul Legislative Code § 324.07; and
 
WHEREAS, this was the second violation within a year, so per Saint Paul Legislative Code § 310.05 (m) (2), the licensing office recommended a $1,000.00 matrix penalty; and
 
WHEREAS, the licensee did respond to the Notice of Violation to request a public hearing but then decided to work with DSI to set up a payment plan in order to pay the $1,000.00 from this violation and the $500.00 matrix penalty from the previous violation imposed by Council on November 10, 2010 (RES #10 -1203); and
 
WHEREAS, the Department of Safety and Inspections agreed to a payment plan and sent the licensee a letter on December 20, 2010 outlining the payment plan and the dates each payment was due; and
 
WHEREAS, the licensee failed to make the first payment which was due on January 15, 2011, now, therefore, be it
 
RESOLVED, that all licenses held by Mostafa H. Abdelhamid d/b/a Superstore Grocery are hereby immediately suspended for failure to pay the first installment on the agreed-to payment plan with DSI.
 
FURTHER RESOLVED, all licenses will remain suspended until the $1,500.00 in matrix penalties for the two separate violations are paid in full to the Department of Safety and Inspections.
