Accepting Grant of Easements to the City of Saint Paul related to the West Flats III Redevelopment.
Body
WHEREAS, the City of Saint Paul (“City”) desires a Grant of Easement for Public Use and an Emergency Access Easement from WSF Phase III A LLC and WSF Phase III B Limited Partnership; related to the West Side Flats III development in Saint Paul, MN; and
WHEREAS, The Public Use and Emergency Access Easements are required per the site plan approval for the WSF Phase III project; and
WHEREAS, The Public Use Easement will provide for public use of a multi-modal pedestrian and bike path that runs through the West Side Flats Phase III redevelopment project and for public space with patios and picnic tables; and
WHEREAS, said Public Use Easement is necessary to permit the City a perpetual, permanent, non-exclusive easement through, over and across a portion of the Burdened Property for the purpose of a public trail and public green space as described in Exhibit B-1 and depicted in Exhibit B-2; and
WHEREAS, said Emergency Access Easement is necessary to permit to the City a perpetual, permanent, nonexclusive easement though, over and across a portion of the Burdened Property for the purpose of emergency access as described in Exhibit A-1 and depicted in Exhibit A-2; now
THEREFORE, BE IT RESOLVED, that the Mayor and Council of the City of Saint Paul accept said easement and direct and authorize the proper city officials to record same with Ramsey County and pay all applicable recording fees.
