Approving adverse action against all licenses held by Ray Vinzant Plumbing at 541 Wheeler Street North.

WHEREAS, all licenses held by Ray Vinzant Plumbing d/b/a Ray Vinzant Plumbing (License ID #20110001218) for the premises located at 541 Wheeler Street North in Saint Paul, were the subject of a Notice of Intent to Suspend Licenses and Impose Penalty dated June 11, 2015, stating the licensee violated Saint Paul Legislative Code §33.03 (a) by allowing employees to install a gas furnace and a boiler without obtaining the appropriate permits to do the work;
WHEREAS, the licensee continued to allow employees, who did not possess Gas Certificates of Competency, to perform work without supervision in violation of Saint Paul Legislative Code § 370.17 (e) (1); and
WHEREAS, an unlicensed employee performed Existing Fuel Burning Safety Test on at least two occasions, but was not accompanied by a licensed, supervising employee in violation of Saint Paul Legislative Code § 370.17 (e) (1); and
WHEREAS, due to the egregiousness of these continued violations, per Saint Paul Legislative Code §310.05 (m) (2), the licensing office recommended a ten (10) day suspension of all licenses and the imposition of a $2,000.00 matrix penalty; and
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend Licenses and Impose Penalty to request a public or administrative hearing; and
WHEREAS, the Notice of Intent to Suspend Licenses and Impose Penalty stated that if the licensee failed to request a public or administrative hearing by June 22, 2015, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, all licenses held by Ray Vinzant Plumbing d/b/a Ray Vinzant Plumbing are hereby suspended for ten days. Said suspension will begin at 12:00 midnight on Wednesday, August 5, 2015 and end at 11:59 p.m. on Friday, August 14, 2015.
