Approving a request by Opus Development Company, L.L.C. to release easements over portions of the properties at 174-224 West Seventh Street.

WHEREAS, a request has been received from Opus Development Company, L.L.C. for the release of existing easements for slopes, cuts and fills along West Seventh Street within the properties as depicted on Exhibit A attached hereto; and
WHEREAS, the easement rights requested to be released are contained in the Plan recorded December 9, 1933 as Document No. 856822 in Book 48 of Plans, Page 10; and
WHEREAS, the Saint Paul Department of Public Works has determined that said easement rights, as they apply to the above properties, may be released; now, therefore be it
RESOLVED, that with the Certificate of Intended Non-Use, filed voluntarily on behalf of the Department of Public Works for the City of Saint Paul, the City for itself and on behalf of said department, waives its rights to the easements identified above; and be it further
RESOLVED, that upon passage of this resolution, said easement rights are released and the proper city officials are hereby authorized and directed to record a copy of this resolution in the office of the Ramsey County Recorder's Office and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificate of Intended Non-Use referenced in this resolution.
