Approving adverse action against the Health/Sport Club and Tanning Facility licenses held by Health Skills, LLC St Paul d/b/a Anytime Fitness, 2501 Seventh Street West.

WHEREAS, adverse action was taken against the Health/Sport Club and Tanning Facility licenses held by Health Skills, LLC St Paul d/b/a Anytime Fitness (License ID #20060001202) for the premises located at 2501 - 7th Street West in Saint Paul by Notice of Intent to Suspend Licenses dated April 8, 2011, alleging licensee failed to pay delinquent license and late fees of $652.00, provide information on tanning beds and submit a completed Certificate of Compliance Minnesota Workers' Compensation Law form; and
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and
WHEREAS, the licensee did respond to the Notice of Intent to Suspend Licenses to pay the delinquent license and late fees but then failed to submit information on the tanning beds and the completed Certificate of Compliance Minnesota Workers' Compensation Law form; and
WHEREAS, the Notice of Intent to Suspend Licenses stated that if the licensee failed to submit the required information by April 18, 2011, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Health/Sport Club and Tanning Facility licenses held by Health Skills, LLC St Paul d/b/a Anytime Fitness are hereby suspended and the licensee is ordered to pay a $500.00 matrix penalty for failure to submit required information in order to maintain the license. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
