Repealing Ordinance Ord 18-40 which amended Chapter 357 of the Legislative Code to Regulate Coordinated Collection.

WHEREAS, on August 8, 2018, the Council adopted Ordinance 18-40 which amended Chapter 357 of the Saint Paul Legislative Code in order to regulate Coordinated Collection; and

WHEREAS, on September 26, 2018, the City received a petition to repeal Ord 18-40 which was legally sufficient; and
WHEREAS, on October 17, 2018, the Council, in RES 18-1760, requested the City Attorney prepare an Ordinance repealing Ord. 18-40; and
WHEREAS, Ord. 18-40 made changes to Chapter 357 of the Saint Paul Legislative Code so that in order to repeal Ord. 18-40 those changes need to be reversed; now, therefore be it
RESOLVED, that the Council of the City of Saint Paul does hereby ordain:
Section 1
Chapter 357 of the Saint Paul Legislative code is hereby amended to read as follows:
Sec. 357.01. - License required; exceptions.
(a) License required. No person shall collect, transport, transfer, treat, handle, salvage, utilize, compact, shred, compost, mill, bale, process or dispose of, or any combination thereof, any mixed municipal solid waste, construction debris, compostable materials or recyclable materials in Saint Paul without a license issued pursuant to the provisions contained in this chapter.
(b) Exceptions. This licensing provision shall not apply to governmental agencies engaged in such activities. Persons who transport, transfer, compact, shred, compost or bale in connection with their own separated recyclable materials and yard waste generated at premises owned or occupied by them are exempt. Persons engaged in recycling activities and licensed under Chapter 408, motor vehicle salvage dealers under Chapter 422 or scrap and metal processors under Chapter 420, or which are hereafter licensed under any other provisions of the Legislative Code regulating recycling activities, are exempt from the license requirements contained in this chapter. 6/14/2019 12:29 PM  For I am really glad to see that you folks are finally taking care of this. The main reason that I signed the petition to hold a referendum on this trash plan ordinance (ord 18-40) was because it prevented neighbors from sharing trash services. There are several people on my block who use to share services and they would have been prevented from continuing that practice if not for this petition (and the other trash plan petition on ordinance-18-39). I was very happy last October when you decided to just repeal it and save us all the trouble and expense of a ballot vote. I still do not understand why you did not do the same for the petition on 18-39. But thanks for doing the right thing on this one. +4 -1 1
