Title

Declaring a hardship to satisfy a petition requirement for a proposed vacation of right-of-way adjacent to the property at 779 Lexington Parkway South.

Body

WHEREAS, R.Scott Ramsay ("Petitioner") is seeking to vacate platted and unimproved right-of-way adjacent to 779 Lexington Parkway South, as requested in the petition attached hereto as Exhibit A, for the purpose of establishing a setback area for a proposed housing development at 779 Lexington Parkway South and other adjoining properties; and

 

WHEREAS, in accordance with the City of Saint Paul's vacation ordinance (Legislative Code, Sec. 130.02 (a) (2)), Petitioner has attempted to secure the support of a majority of property owners whose properties abut the proposed vacation area in order to satisfy one of the petition requirements, but has been unable to secure signatures from said owners; and

 

WHEREAS, Petitioner believes the vacation would not adversely impact said owners' use of their properties; and

 

WHEREAS, pursuant to Legislative Code, Sec. 130.02 (a) (3), Petitioner believes that a hardship therefore exists and requests that the Saint Paul City Council waive the majority requirement; now, therefore, be it

 

RESOLVED, that the Mayor and Council of the City of Saint Paul do hereby declare that a hardship exists with respect to the proposed petition to vacate right-of-way easement rights adjacent to 779 Lexington Parkway South, and that the requirement to obtain support from a majority of abutting property owners is hereby waived.
