Approving a Liquor Outdoor Service Area (Patio) license with conditions for Taco Nachos and Beer, LLC, d/b/a Tacos Nachos and Beer (License ID #20120005250) at 5 Seventh Place West.

Body
WHEREAS, Taco Nachos and Beer, LLC d/b/a Tacos Nachos and Beer (License ID #20120005250) applied for a Liquor Outdoor Service Area (Patio) license for the licensed premises located at 5 -7th Place West in Saint Paul; and

WHEREAS, the other licenses pending are a Restaurant (3) 13-50 Seats, a Wine On Sale and a Malt On Sale (Strong); and

WHEREAS, the licensed establishment is located downtown, a petition was not required in order to apply for the Liquor Outdoor Service Area (Patio) license; and

WHEREAS, notices were sent out and DSI received no objections to the issuance of the Liquor Outdoor Service Area (Patio) license; and

WHEREAS, the licensee signed a license condition affidavit listing conditions below:

1. Per City of Saint Paul Legislative Code 409.15 (a)(2), On-Sale wine license shall
mean a license authorizing the sale of wine not exceeding fourteen (14) percent alcohol by volume, for consumption on the licensed premises only in conjunction with the sale and service of food (menu item only). The sale of Malt (Strong) will also take place only in conjunction with the sale and service of food.

2. Per City of Saint Paul Legislative Code 409.15 (e), licensee must be able to show the
gross receipts are at least sixty (60) percent attributable to the sale of food.

3. Licensee will submit to the Department of Safety and Inspections (DSI) annual gross
receipts for food and liquor the each year the license is renewed.

4. Licensee shall take appropriate measures to ensure that the outdoor consumption of
wine/beer is limited to the defined area as shown on the plan on file with DSI.

WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the Liquor Outdoor Service Area (Patio) license with conditions; now...
