Purpose: An appeal of a decision by the Board of Zoning Appeals declining to approve a zoning variance requested by the Department of Administration. The zoning code limits the height of fences constructed between off-street parking facilities and the public right-of-way to 4.5 feet; 10’ was proposed along Phalen Boulevard and Barclay Street, for a variance of 5.5’ on each side.

District Council Recommendation: Greater East Side Community Council submitted a letter opposing the request.

 

Board of Zoning Appeals Decision: No motions passed. A motion to deny the request failed in a 3 (yes) - 2 (no) vote.  A motion to approve failed in a 3 (yes) - 2 (no) vote. Per SPLC § 61.203, less than 4 votes in any direction fails.
