Authorizing the Saint Paul Police Department to accept a bequest from the Nancy E. Sittard Irrevocable Trust for the purchase, training, and care for police dogs.
Body

WHEREAS, Saint Paul Administrative Code Section 41.03 allows the City to accept any form of donation, subject to the following requirements: (a) All donations of any type in any amount of value shall be received and processed in accordance with proper and accepted accounting practices. (b) All donations shall be received and accepted by city council actions according to Section 41.03 and according to reporting procedures established by administration and approval by the city council. (c) All donations shall be made public and subject to periodic audit; and

WHEREAS, The late Nancy Sittard, by and through the Nancy E. Sittard Irrevocable Trust (the “Trust”), donated a portion of her estate, representing 10% of the assets of the Trust, to the Saint Paul Police Department (the “Department”), with the bequest intended to be used “to purchase, train and care for police dogs”; and

WHEREAS, The value of Ms. Sittard’s bequest is $266,644.58 US; and

WHEREAS, The Department can beneficially use the donated funds to purchase, train and care for police dogs, and would like to accept Ms. Sittard’s bequest; and

WHEREAS, Other than the requirement that the donated funds be used to purchase, train and care for police dogs, Ms. Sittard’s bequest contains no conditions, and creates no obligations, on the City of Saint Paul or the Department; and

WHEREAS, It is in the best interests of the City and the Department to accept Ms. Sittard’s request; now, therefore, be it

RESOLVED, That the City Council hereby accepts Ms. Sittard’s donation of 10% of the assets of the Trust, and appropriates it to the intended use. The City Council authorizes and directs the Office of the City Attorney to sign all documents necessary to formalize the acceptance of Ms. Sittard’s bequest. The City Council thanks Ms. ...
