Appeal of Sam Manning, Southern Minnesota Regional Legal Services, representing Gordon Anderson, to a Notice of Condemnation as Unfit for Human Habitation and Order to Vacate plus Summary Abatement Order at 134 CASE AVENUE.

 

Date/Time of 1st LH:  July 19, 2016, 11:30 a.m.

Purpose of Appeal:  Owner is disabled; need more time to correct violations and obtain services.  Owner has arthritis and a heart condition.  Owner is in the process of contacting House Calls for assistance.

Date of Order(s) Under Appeal:  June 9 and June 10 respectively

Inspector/Key Staff:  Lisa Martin

Legislative Hearing Staff Comments:  Legislative Hearing Officer told staff to take this untimely appeal.  There is a Notice to Cut Tall Grass, but that has already been abated, according to SMRLS.

WHEREAS, in the matter of the Appeal of Sam Manning, Southern Minnesota Regional Legal Services, representing Gordon Anderson, to a Notice of Condemnation as Unfit for Human Habitation and Order to Vacate plus Summary Abatement Order at 134 CASE AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

 

WHEREAS, the Legislative Hearing Officer recommends that the City Council grant the appeal contingent upon 1) granting inspector access to all areas of the building by no later than July 22, 2016; 2) working with the House Calls Porgram to have the the house cleaned and sanitized by July 29, 2016 - which will meet the requirements of the refrigerator and furnace installers for them to enter the premise; and 3) removing the vehicles, wood and tree debris from the back yard by Jul 29, 2016; and 4) grant until August 12 for installation of the refridgerator and furnace; Now, Therefore, Be It

 

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
