Approving adverse action against the Taxicab Driver (Provisional) license application submitted by Daniel Patrick Lawler for the City of Saint Paul.

WHEREAS, the Taxicab Driver (Provisional) license application submitted by Daniel Patrick Lawler (License ID #20150002346) for the City of Saint Paul was the subject of a Notice of Intent to Deny License dated September 11, 2015, stating that the applicant had been convicted on April 19, 1996 of Felony Attempted Murder-1st Degree in Washington County in violation of Minn. Stat. § 609.185.3; and
WHEREAS, the applicant was also convicted on April 19, 1996 of Felony Burglary-1st Degree (Minn. Stat. § 609.582.1), Felony Kidnapping to Facilitate Felony or Flight (Minn. Stat. § 609.25.1 2), Felony Aggravated Robbery-1st Degree (Minn. Stat. § 609.245.1), Felony Assault-1st Degree (Minn. Stat. § 609.221) and Felony Assault-2nd Degree (Minn. Stat. § 609.222); and
WHEREAS, the applicant was placed on Supervised Probation for these convictions which was discharged as of August 26, 2012; and
WHEREAS, based on this information, the licensing office recommended license denial per Saint Paul Legislative Code § 376.16 (e) (4) and Saint Paul Legislative Code
§ 376.16 (e) (4) (a); and
WHEREAS, the applicant did not respond to the Notice of Intent to Deny License to request a public or administrative hearing or withdraw his license application; and
WHEREAS, the Notice of Intent to Deny License stated that if the applicant failed to request a public or administrative hearing or withdraw his license application by September 21, 2015, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Taxicab Driver (Provisional) license application submitted by Daniel Patrick Lawler is hereby denied.
