Authorizing the City to enter into an agreement with the Minnesota Department of Transportation (MnDOT) for their Trunk Highway 5 Project.
Body
WHEREAS, MnDOT has a project to on Trunk Highway 5 from Shepard Road to Edgcumbe Road; and
WHEREAS, MnDOT will need to remove and reinstall the City owned and operated lighting system within the project limits; and
WHEREAS, the City agrees to pay MnDOT the cost of this work as outlined in the agreement; and
WHEREAS, this agreement contains an indemnification clause in favor of MnDOT, which the Council finds reasonable and appropriate; now, therefore be it
RESOLVED, that the Mayor and the proper City Officials are hereby authorized and directed for and on behalf of the City to enter into MnDOT Agreement No.1063291 with the State of Minnesota, a copy of which is before Council and is made a part hereof; and, be it finally
RESOLVED, that the Mayor and the proper City Officials are authorized to execute the Agreement and any amendments to the Agreement.
