Authorizing the proper City officials to enter into a cooperative agreement with the Minnesota Department of Natural Resources for the reconstruction of the Gateway State Trail bridge over Westminster Street and the Arkwright Street Local Trail Connection.
Body
WHEREAS, the Commissioner of the State of Minnesota Department Natural Resources (“State”) has the authority, duty, and responsibility under Minnesota Statutes Section 86A.015 to provide state trails and associated facilities; and under subdivision 14b, to establish, develop, maintain and operate the Gateway State Trail; and
WHEREAS, the State intends to replace the Gateway State Trail bridge over Westminster Street within the City of Saint Paul; and
WHEREAS, the City owns and/or administers parcels impacted by construction, as shown on the map attached and incorporated into this Agreement as Exhibit B; and
WHEREAS, the City will allow for the construction of the Gateway State Trail bridge on City owned or administered lands located adjacent to Westminster Street and as referenced in Exhibit B;
WHEREAS, as part of the Gateway State Trail bridge reconstruction project, the State will construct a Local Trail Connection to Arkwright Street, which the City and State agree is of mutual benefit to both entities; and
WHEREAS, upon completion of the Gateway State Trail bridge reconstruction project, the City will own and maintain the Local Trail Connection at Arkwright Street; now, therefore be it
RESOLVED, that the Council of the City of Saint Paul hereby authorizes the proper City officials to execute the Cooperative Agreement and any amendments to the Agreement, a copy of which is before the Council and is made a part hereof.
