Accepting a public right-of-way easement from Robert Street LLLP in connection with a residential development at 176 Robert Street South.
Body
WHEREAS, Schafer Richardson is in the process of developing a new residential apartment complex to be named Soul Apartments (“Development”) located at 176 Robert Street South (“Property”); and
WHEREAS, the Property is owned by Robert Street LLLP ("Property Owner"); and
WHEREAS, as part of the site plan approval process for the Development the Department of Public Works (“Public Works”) of the City of Saint Paul ("City") is requiring a permanent right-of-way easement ("Easement") over the southwest corner of the Property near the intersection of Robert Street South and Plato Boulevard East; and
WHEREAS, the Property Owner has agreed to provide the Easement and is now requesting that the City accept the Easement, as provided in Exhibit A attached hereto; and
WHEREAS, Public Works has reviewed and approved the Easement as attached; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul does hereby accept the Easement as set forth in Exhibit A attached hereto and authorize the proper city officials to accept an executed original and record same with the Ramsey County Recorder's Office and/or Registrar of Titles.
