Authorizing the Department of Safety and Inspections to enter into a conditional delegation agreement with the Minnesota Department of Health to act as a local designated agent for the purposes of environmental health licensing, inspection, reporting and enforcement.
Body
WHEREAS, Minnesota Statutes section 145A.07 authorizes the Minnesota Department of Health to delegate duties relating to environmental health licensing, inspection, reporting, and enforcement to designated agents; and
WHEREAS, the City has been a designated agent of the Minnesota Department of Health; and
WHEREAS, the Council finds that the City should continue to serve as a designated agent; and
WHEREAS, the Minnesota Department of Health has offered a 2012 Conditional Delegation Agreement, which includes terms for Department of Health delegation, supervision, and consultation effective for twenty-four months, and which is on file with the Department of Safety and Inspections.
WHEREAS, the Office of Financial Services and the Department of Safety and Inspections are conducting a business licensing rate study, which will include a study of environmental health licenses issued pursuant to the delegation agreement.
NOW THEREFORE BE IT RESOLVED, that the proper City officials are hereby authorized and directed to execute a conditional delegation agreement, in substantially the same form as the 2012 Conditional Delegation Agreement on file with the Department of Safety and Inspections, to act as a designated agent for the Minnesota Department of Health for the purposes of environmental health licensing, inspection, reporting, and enforcement in the City of Saint Paul; a copy of said agreement is to be kept on file and of record in the Office of Financial Services.
