Pertaining to Amendment No. 1 to the Private Water Main Agreement with WestSP Development Partners, LLC (“Developer”) to supply water to the Thompson Oaks Development at 160 Thompson Avenue East in the city of West Saint Paul.

WHEREAS, Wentworth Place, LLC (“Developer”) entered into a Private Water Main Agreement (“Agreement”) with the Board of Water Commissioners dated October 10, 2006, to provide domestic water service and fire protection to certain properties, including 131 - 143 Loren Lane and 1551 - 1563 James Ave and described in the attached Exhibit A; and
WHEREAS, the Agreement set forth terms and conditions required by the city attorney’s office for the installation and operation of a private water main; and
WHEREAS, WestSP Development Partners, LLC has now requested permission to construct an extension of said private water main to provide domestic water service and fire protection to certain property, located at 160 Thompson Ave East and described in the attached Exhibit B; and
WHEREAS, staff has prepared an Amendment No. 1 to Agreement, which provides for said private main extension, and which binds Developer to all terms and conditions of said October 10, 2006 agreement, and which Saint Paul Regional Water Services General Manager recommends approval of said Amendment; now, therefore, be it
RESOLVED, that the Board of Water Commissioners hereby approves Amendment No. 1 to Private Water Main Agreement with WestSP Development Partners, LLC to provide domestic water service and fire protection to property, located at 160 Thompson Ave East and described in the attached Exhibit B.
