Authorizing Benjamin Helberg and Tara Schwerger to proceed In Forma Pauperis on their appeal of the destruction of a dangerous dog.

Body

WHEREAS, on June 17, 2019 the Department of Safety and Inspections Hearing Officer issued an Order to Destroy a dog owned by Benjamin Helberg and Tara Schwerger; and

 

WHEREAS, the owners filed a Writ of Certiorari to appeal the decision on July 1, 2019 and have now filed a Motion to Proceed In Forma Pauperis with Mr. Helberg’s and Ms. Schwerger’s affidavits filed on July 16. 2019; and

 

WHEREAS, Rules 109 and 115 of the Minn. Rules of Civil Appellate Procedure require that the city council grant the motion if they find that the parties are indigent and that the appeal is not frivolous; and

 

WHEREAS, review of the affidavits shows that the parties have submitted sufficient information to show that they are unable to pay for the costs of this appeal; now, therefore, be it

 

RESOLVED, that the Saint Paul City Council grants the Motion of Benjamin Helberg and Tara Schwerger to proceed in forma pauperis in the case of Benjamin Helberg and Tara Schwerger v. City of Saint Paul, DSI Animal Control, Court of Appeals # A19-1006.
