Title

Requesting City acceptance of a downtown parcel from the Saint Paul Port Authority as part of the skyway and pedestrian tunnel connection between the RiverCentre and Landmark Tower.

Body

WHEREAS, in 1999 and 2000 the City of Saint Paul ("City"), Saint Paul Port Authority ("Port Authority"), Ramsey County, Capital City Properties, and Saint Paul Convention and Visitors Bureau Foundation worked cooperatively to assemble financing, acquire property, and design and construct a pedestrian connection between the RiverCentre Complex and the existing skyway system connecting to the Landmark Tower building (the "Project"); and

 

WHEREAS, the Project included purchase by the Port Authority of a parcel of land located at 56 Fourth Street West, Parcel ID No. 06.28.22.13.0020 (the "Property"), as the site of a new structure with stairway and elevator to connect the underground pedestrian tunnel from the RiverCentre along Fourth Street to an above-street skyway bridge attached to Landmark Tower; and

 

WHEREAS, in accordance with Sec. 2.1 of the RiverCentre Pedestrian Link Cooperative Agreement ("Cooperative Agreement") between the parties, attached hereto as Exhibit A, the Port Authority was to acquire the Property and promptly transfer ownership to the City, which transfer did not occur; and

 

WHEREAS, the Port Authority has requested the conveyance of the Property to the City, and the Port Authority's board of directors has authorized said conveyance; and

 

WHEREAS, the City has agreed to accept the Property from the Port Authority; now, therefore, be it

 

RESOLVED, that in accordance with the Agreement, the Mayor and City Council hereby accept the Property, as documented in the quitclaim deed attached hereto as Exhibit B, and authorize the proper city officials to record said deed with the Ramsey County Registrar's Office and/or Recorder's Office.
