Resolution Authorizing and Approving an Amended Access Easement over Entire Vacated Woodward Avenue and Part of East Street, Payne-Phalen District 5, Ward 7

WHEREAS, by Res PH 16-441 the HRA Board of Commissioners authorized and approved the the Conveyance of the North Half of Vacated Woodward Avenue and Part of East Street to Lombardo Family LLLP (“Lombardo”) and Acceptance of an Access Easement (“Access Easement”) over Entire Vacated Woodward Avenue and Part of East Street (“2016 Resolution”); and
WHEREAS, Lombardo has requested that to facilitate its conveyance of land to the City of Saint Paul for right of way purposes that the Access Easement be amended so as to limit access to the cell tower area only on the HRA owned land instead of providing unlimited access to the entire HRA owned land (“Amended Access Easement”); and
WHEREAS, the HRA Board finds a public purpose for the actions taken in this resolution.
NOW THEREFORE BE IT RESOLVED by the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota, as follows:
1. The Amended Access Easement from Lombardo to the HRA is hereby approved.
2. The HRA Executive Director and staff are authorized and directed to take all actions needed to implement this Resolution.
