Approving adverse action against all licenses held by Mostafa H. Abdelhamid, d/b/a Superstore Grocery, located at 873 Rice Street in Saint Paul.

WHEREAS, adverse action was taken against the all licenses held by Mostafa H. Abdelhamid d/b/a Superstore Grocery (License ID #20090002813) for the premises located at 873 Rice Street in Saint Paul by Notice of Violation dated October 7, 2010, alleging when an inspector entered the establishment on September 28, 2010, she noticed a lit cigarette on a counter behind the clerk in violation of Minn. Stat. § 144.414, Subd. 1 (Clean Indoor Air Act); and
WHEREAS, per Saint Paul Legislative Code § 310.05(m) (2), the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, licensee did not respond to the Notice of Violation to pay the $500.00 matrix penalty or request a hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a hearing by October 18, 2010, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that Mostafa H. Abdelhamid d/b/a Superstore Grocery is hereby ordered to pay a matrix penalty of $500.00 for allowing a clerk to smoke inside the establishment in violation to Minn. Stat. § 144.414, Subd. 1 (Clean Indoor Air Act). Payment of such penalty shall be made within thirty days of the date of the adoption of this resolution.
