Body

WHEREAS, the Massage Practitioner license application submitted by Christopher James Burgess (License ID #20140002236) for the premises located at 762 Cleveland Avenue in Saint Paul, was the subject of a Notice of Intent to Deny License dated February 23, 2015, stating on February 13, 2015, the license applicant filed a Petition to Enter a Guilty Plea in Hennepin County and was convicted of Gross Misdemeanor Criminal Sexual Conduct - 5^th Degree - Nonconsensual Sexual Contact in violation of Minn. Stat. § 609.3451.1; and

WHEREAS, per Saint Paul Legislative Code §310.06 (b) (6) (c), the licensing office recommended license denial; and   

WHEREAS, the licensee did not respond to the Notice of Intent to Deny License to either request a public or administrative hearing or withdraw his license application; and   

WHEREAS, the Notice of Intent to Deny License stated that if the licensee failed to request a public or administrative hearing or withdraw his license application by March 5, 2015, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it

RESOLVED, the Massage Practitioner license application submitted by Christopher James Burgess is hereby denied.
