Approving the removal of railway tracks along Wabash Avenue under Ordinance No. 2728 (Nov. 21, 1907).

WHEREAS, on November 21, 1907, the City authorized the Minnesota Transfer Railway Company to install railway tracks within the Wabash Avenue right-of-way under Ordinance No. 2728, which is attached to this resolution; and
WHEREAS, the City of Saint Paul is planning capital improvements within the Wabash Avenue right-of-way that necessitate the removal of the railway tracks, generally between Eustis Street and Raymond Avenue, including improvements to roadways, sidewalks, bikeways, drainage, subsurface utilities, and other elements within the right-of-way; and
WHEREAS, the current owner, agent, and/or successor of the Minnesota Transfer Railway Company for this railway track is M T Properties, Inc.; and
WHEREAS, M T Properties, Inc. does not object to the City’s plans to remove these railway tracks; and
WHEREAS, Section 1(b) of Ordinance No. 2728 (Nov. 21, 1907) says “all of said tracks, or any part thereof, shall be taken up and removed from said street and the street restored to its original condition whenever the Common Council of the City of Saint Paul shall so order”; now, therefore be it
RESOLVED, that the Council for the City of Saint Paul orders and approves the removal of the railway tracks along Wabash Avenue, from the easterly terminus of the Wabash Trail to the westerly terminus of Bridge No. 62842, and from the easterly terminus of Bridge No. 62842 to the eastern right-of-way boundary at the intersection of Wabash Avenue and LaSalle Street, and includes all other segments of spurs within the public right-of-way in the above limits as required by Ordinance No. 2728 (Nov. 21, 1907).
