Title
Approving adverse action against all licenses held by GNJ Enterprises, LLC, d/b/a Tin Cup Bar & Restaurant,1220 Rice Street.
Body
WHEREAS, adverse action was taken against all licenses held by GNJ Enterprises, LLC d/b/a Tin Cup Bar & Restaurant (License ID #20110002214) for the premises located at 1220 Rice Street in Saint Paul by Notice of Violation dated November 3, 2011, alleging that on October 2, 2011, the licensee held a special event outside the licensed establishment serving food and beverages without obtaining the appropriate license; and
 
WHEREAS, per Saint Paul Legislative Code ยง 310.05 (m) (2), the licensing office recommended a $500.00 matrix penalty; and    
 
WHEREAS, licensee did respond to the Notice of Violation by sending a letter to the Department of Safety and Inspections (DSI) on November 10, 2011, explaining the situation and requesting an administrative hearing; and
WHEREAS, based on the fact that the licensee did admit to some of the violation, an Amended Notice of Violation was sent to the licensee on November 16, 2011, requesting a new response; and
WHEREAS, after a discussion on the phone with the Assistant City Attorney on November 21, 2011, the licensee then decided to request a public hearing which was held on December 21, 2011; now, therefore, be it
RESOLVED, that GNJ Enterprises, LLC d/b/a Tin Cup Bar & Restaurant is hereby ordered to pay a matrix penalty of $500.00 for providing food and beverages outside of the licensed premises without obtaining the appropriate license.  Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.     
 
This resolution, and action taken above, is based upon facts contained in the November 3, 2011 Notice of Violation and November 16, 2011, Amended Notice of Violation sent to the licensee and the arguments made at the public hearing on December 21, 2011.
