Appeal of Nikolla Erindi, on behalf of Elton Mykerezi, to a Fire Inspection Correction Notice, which includes condemnation, at 104 DALE STREET NORTH.

Purpose of Appeal: Vacate order was issued because temperature measurements in part of the property fell short of 68F. We believe that a tenant behind on rent was intentionally tempering with the system. We consulted two different HVAC contractors (we will submit their statements before the hearing) and took many measures of system performance and actual temperature. It only takes a few minutes for a tenant to shut down the system and open doors of windows to cause low temp. readings. There is no way for us to prevent that in a single family home.

WHEREAS, in the matter of the Appeal of Nikolla Erindi, on behalf of Elton Mykerezi, to a Fire Inspection Correction Notice, which includes condemnation, at 104 DALE STREET NORTH, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council [recommendation]; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
