Title
Authorizing the City to enter into an agreement with MnDOT for the ownership and maintenance of a pipe and drainage structure along I-94 north of the Kellogg Boulevard bridge crossing.
Body
WHEREAS, the State will perform pavement rehabilitation construction and other associated construction upon, along, and adjacent to Trunk Highway No. 94 from Western Avenue to Mounds Boulevard; and
WHEREAS, the State has included in its contract a new segment of the pipe and drainage structure to be constructed under I-94 north of the Kellogg Boulevard bridge crossing as shown in Maintenance Exhibit A; and
WHEREAS, the City has agreed to own and provide routine maintenance for the pipe and drainage structure after acceptable completion of the construction, as defined in the Agreement; now, therefore be it
RESOLVED, that the Mayor and the proper City Officials are hereby authorized and directed for and on behalf of the City to enter into MnDOT Agreement No. 1045873 with the State of Minnesota, a copy of which is before Council and is made a part hereof; and be it finally
RESOLVED, that the Mayor and the proper City Officials are authorized to execute the Agreement and any amendments to the Agreement.
