WHEREAS, the Cigarette/Tobacco license (the “License”) held by Mohammad Ibrahim and Abdullane Ali, d/b/a Annapolis Super USA #002 (License ID# 20160003307), at 1333 Thomas Avenue in Saint Paul (the “Licensed Premises”) was the subject of a Notice of Violation and Request for Imposition of a 10-Day Suspension, herein incorporated as Exhibit 1 (the “Notice”) sent May 25, 2022; and
WHEREAS, the Notice alleged that, during a complaint-based inspection on May 12, 2022, an inspector from the Department of Safety and Inspections (the “Department”) observed and documented with photographs multiple flavored tobacco products that were in glass cabinets and behind the counter/cash register in violation of Saint Paul Legislative Code section 324.07(j); and
WHEREAS, the inspector also noticed hidden flavored tobacco products in a bag under the cash register and under a shirt box; and
WHEREAS, under the penalty matrix contained in Saint Paul Legislative Code section 324.10(b)(2), the presumptive penalty for a first-time violation of section 324.07(j) is a 10-day suspension; and
WHEREAS, the Notice stated that if, the Licensee failed to request a public or administrative hearing by June 8, 2022, the matter would be placed on the next available consent agenda to impose the recommended penalty; and
WHEREAS, the Licensee did not respond to the Notice by June 8, 2022 to request a public or administrative hearing; now, therefore, be it
RESOLVED, that the Cigarette/Tobacco license held by Mohammad Ibrahim and Abdullane Ali, d/b/a Annapolis Super USA #002 (License ID# 20160003307), for the premises located at 1333 Thomas Avenue is hereby suspended for 10 days for having a large amount of flavored tobacco products on the Licensed Premises.
