Title
Authorizing the Parks and Recreation Department to enter into a grant agreement with and provide indemnification for the State of Minnesota, Department of Transportation, to accept a $6,432,978.92 FHWA High Priority grant for the Robert Piram Regional Trail, and to amend the budget to include additional monies.

Body
WHEREAS, on some City of Saint Paul transportation related projects, the City finances either whole or in part with federal funding; and

WHEREAS, under the Minnesota Statutes Section 161.36, the City desires the Commissioner of Transportation be appointed as the City’s agent in accepting federal aid funds made available for construction of a portion of the Robert Piram Regional Trail (Harriet Island to South Saint Paul Regional Trail), between Harriet Island and Mississippi River Regional Trails; and

WHEREAS, the MnDOT grant agreement contains a requirement that the City indemnify MnDOT against any claims or costs including actions related to the certification of DBE participation; and

WHEREAS, acceptance of the federal funds will allow the project to proceed and the project will benefit the public by preparing the trail connection project for bid opening, and the trail connection project itself will add to the recreational opportunities for Saint Paul; and

WHEREAS, the Department of Parks and Recreation would like to amend the 2018 Capital Budget to reflect the full amount of the FHWA funding available for this project; and

WHEREAS, the Mayor, pursuant to Section 10.07.1 of the Charter of the City of Saint Paul, does certify that there are available for appropriation, funds of $6,432,978.92 in excess of those estimated in the 2018 Capital Improvement Budget; now, therefore, be it
