Pertaining to the Permit Agreement with Rice Street Gardens for the purpose of developing and maintaining a community garden on Board property.

WHEREAS, the Board of Water Commissioners of the City of Saint Paul, acting through its Saint Paul Regional Water Services General Manager (“Board”), and Galilee Evangelical Lutheran Church (“GELC”) entered into an agreement the 16th day of March, 2016, permitting GELC to use the Premises addressed as 1958 Rice Street in the City of Maplewood for the purpose of developing and maintaining a community garden for non-commercial purposes only (“Agreement”) ; and
WHEREAS, GELC is no longer affiliated with the community garden, therefore a new agreement was formulated designating, Rice Street Gardens, a Minnesota domestic nonprofit corporation (“RSG”), as the permit holder; and
WHEREAS, RSG has provided a written request for a 12-month extension of the Agreement through December 31, 2025; and
WHEREAS, the Board does so desire to approve such request, thereby issuing a permit agreement to RSG expiring on December 31, 2025, with the option to renew for one-year periods thereafter; now, therefore, be it
RESOLVED, that the Agreement between the Board of Water Commissioners of the City of Saint Paul and the Rice Street Gardens for the purpose of developing and maintaining a community garden on certain Board-owned property addressed as 1958 Rice Street is hereby approved and that the proper officers are hereby authorized and directed to execute said agreement and renewals on behalf of the Board.
