Recalling RES 19-544 pending a hearing before an Administrative Law Judge regarding Midway Amoco BP at 1347 University Avenue.

WHEREAS, RES 19-544 which approved adverse action and the imposition of a $500 matrix penalty against the Cigarette/Tobacco and Gas Station licenses held by Midway University & Hamline LLC, d/b/a Midway Amoco BP at 1347 University Avenue West was approved by council on April 17, 2019 and signed by the Mayor on 4/24/2019; and
WHEREAS, RES 19-544 should have been withdrawn due to the request of the licensee for a hearing before an Administrative Law Judge; and
WHEREAS, a hearing on this matter is scheduled before Administrative Law Judge, LauraSue Schlatter on July 16, 2019; therefore be it
RESOLVED that RES 19-544 is recalled, the $500 fine imposed is rescinded and the request for a $500 matrix penalty is suspended pending the outcome of the Administrative Law Hearing.
