Approving adverse action against the Sidewalk Contractor license held by Guy Nelson Construction, LLC.

WHEREAS, adverse action was taken against the Sidewalk Contractor license held by Guy Nelson Construction, LLC d/b/a Guy Nelson Construction LLC (License ID #20120002112) for the City of Saint Paul, by Notice of Intent to Suspend License dated April 1, 2013, alleging licensee failed to pay delinquent license and late fees of $250.00, submit current certificates of insurance, a current $5,000.00 Sidewalk Bond and a completed Certificate of Compliance Minnesota Workers' Compensation Law form; and
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and
WHEREAS, the licensee did respond to the Notice of Intent to Suspend License on April 8, 2013 to state he no longer wished to operate his Sidewalk Contractor license in Saint Paul and he would send a letter to DSI cancelling his license; and
WHEREAS, the licensee failed to follow-up after the telephone conversation to submit the letter to DSI cancelling his Sidewalk Contractor license; and
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to pay the delinquent license and late fees and submit the required information or request a hearing by April 11, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Sidewalk Contractor license held by Guy Nelson Construction, LLC d/b/a Guy Nelson Construction LLC is hereby suspended for failure to pay delinquent license and late fees of $250.00.
FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit required information in order to maintain the license.
