Approving the application of Nativity of Our Lord Catholic Parish/School for a Nativity County Fair event on Friday, 09/12/2025, Saturday, 09/13/2025 and Sunday, 09/14/2025 for a sound level variance in order to present live amplified sound at the Nativity of Our Lord Catholic Parish/School, 1900 Wellesley Avenue.

WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and
WHEREAS, §293.09 provides for the granting of variances from the sound level limitations contained in §293.07, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on the applicant, other persons or on the community; and
WHEREAS, Nativity of Our Lord Catholic Parish/School, represented by Michael Reif, Nativity County Fair Steering Committee Member, who has been designated as the responsible person on the application, has applied for a variance, at a requested sound level limit of 90 dBA at no specified distance, to present amplified sound for the Nativity of Our Lord Catholic Parish/School for a Nativity County Fair event on September 12, September 13 and September 14, 2025 at Nativity of Our Lord Catholic Parish/School, 1900 Wellesley Avenue. Applicant has requested a variance for the hours of 5:00 p.m. until 10:00 p.m., with a pre-event sound check at 3:00 p.m. on Friday, September 12; for the hours of 12:00 p.m. until 10:00 p.m. on Saturday, September 13, 2025, and the hours of 10:00 a.m. until 3:00 p.m. on Sunday, September 14, 2025 for a Parish Nativity County Fair event; and
WHEREAS, if applicant is not granted a variance applicant will not be able to present amplified sound at the September 12, September 13 and September 14, 2025 at the Nativity of Our Lord Catholic Parish/School, Nativity County Fair event,1900 Wellesley Avenue.; and
