Approving adverse action against the Solid Waste Hauler, and Vehicle and Solid Waste Hauler (Each Additional Vehicle) licenses held by Susan Stewart, d/b/a Highland Sanitation & Recycling, Inc.

WHEREAS, adverse action was taken against the Solid Waste Hauler & Vehicle and Solid Waste Hauler (Each Additional Vehicle) licenses held by Susan Stewart d/b/a Highland Sanitation & Recycling, Inc. (License ID #0032544) for the City of Saint Paul by Notice of Intent to Suspend Licenses dated September 15, 2011, alleging licensee failed to respond to a SECOND REQUEST from the Department of Safety and Inspections to submit copies of current truck inspection reports for five of her vehicles; and        
 
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and   
 
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend Licenses to submit the required reports or request a hearing; and  
 
WHEREAS, the Notice of Intent to Suspend Licenses stated that if the licensee failed to submit the required reports or request a hearing by September 26, 2011, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Solid Waste Hauler & Vehicle and Solid Waster Hauler (Each Additional Vehicle) licenses held by Susan Stewart d/b/a Highland Sanitation & Recycling, Inc. are hereby suspended and the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit required truck inspection reports.  Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
