Authorizing the release of Utility Easements within the property located at 1979 Old Hudson Road.

WHEREAS, a request has been received by the owner of property located at 1979 Old Hudson Road, as depicted in Exhibit A attached hereto (the "Property"), for the release of existing utility easements within a portion of the Property, described as:
The South thirty (S.30) feet of Lot nine (9), Block eight (8), Hudson Road Gardens; except that part which lies southerly of a line run parallel with and distant thirty-five (35) feet northerly of the following described line: From a point on the east line of Section 35, Township 29 North, Range 22 West, distant 577.1 feet north of the southeast corner thereof, run northwesterly at an angle of 79 degrees 19 minutes with the said East Section line for 1360.1 feet; thence deflect to the left at an angle of 1 degree 52 minutes 50 seconds for 749.59 feet; thence deflect to the right at an angle of 90 degrees, 00 minutes for 123 feet to the point of beginning of the line to be described; thence deflect to the left at an angle of 57 degrees 54 minutes 04 seconds for 436.33 feet; thence deflect to the left on a 16 degree 00 minute curve (delta angle 67 degrees 45 minutes) for 423.44 feet; thence on tangent to said curve for 156.1 feet; thence deflect to the right on a 12 degree 00 minute curve (delta angle 54 degrees 41 minutes) for 455.69 feet and there terminating, all lying within the City of Saint Paul, Ramsey County, Minnesota.

WHEREAS, the easement rights requested to be released were originally conveyed to the City of Saint Paul ("City") and the Board of Water Commissioners of the City of Saint Paul ("Water Board") in the following documents:
1) "Grant of Utility Easement," filed of record with Ramsey County as Doc. No. 530608 on December 17, 1968, and
2) "Agreement" (granting utility easement), filed of record with Ramsey County as Doc. No. 530950 on December 26, 1968,
