Approving the partial release of the utility easement rights referenced in Ramsey County, Document Number 4970150.

WHEREAS, on October 12, 2022, the St. Paul City Council approved resolution RES PH 22-301, the vacation of alley right-of-way in Block 1, Missabe Addition, St. Paul, Minnesota; the vacation resolution was recorded in Ramsey County property records as Document Number 4970150 on November 7, 2022, a copy of which is attached hereto; and
WHEREAS, easement rights were retained for utilities which have existing facilities in the now vacated alley; and
WHEREAS, Nancy Schapiro, property owner of 670 Howell Street South, as shown in Exhibit A, has requested the release of the easement rights encumbering the property in Exhibit A, as referenced in Ramsey County Document Number 4970150; now, therefore, be it
RESOLVED, that with the Certificate of Intended Non-Use filed voluntarily by Xcel Energy, the response of Comcast (dba Xfinity) and a determination made on behalf of CenturyLink (dba Lumen), the City, on behalf of these utilities, hereby waives, releases and terminates all easement rights encumbering the property in Exhibit A, as referenced in Ramsey County Document Number 4970150, recorded November 7, 2022; and be it further
RESOLVED, the proper City officials are hereby authorized and directed to record a copy of this resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file the utility companies' responses referenced this resolution; and be it finally
RESOLVED, that all other terms and conditions of Ramsey County Document Number 4970150 shall remain in full force and effect and be fully incorporated into this resolution.
