Authorizing the Department of Parks and Recreation to enter into a rental agreement, which includes an indemnification clause, with Macalester University for use of their facilities in staging Star of the North Games.

WHEREAS, the City of Saint Paul is hosting the Star of the North Games June 22-23, 2013, and needs to enter into rental agreements for various events associated with the Games; and
WHEREAS, Parks and Recreation wished to enter into a rental agreement with Macalester University for use of their facilities and the agreement contains an indemnification requirement; and
WHEREAS, the Saint Paul City Council finds that the Star of the North Games will bring visitors to the City and will enhance opportunities for enjoyment by the citizens and visitors, and has a legitimate public purpose; and
WHEREAS, the expenditure of public funds, which includes the promise of indemnification and defense, for such a purpose will facilitate and enable it to take place; now therefore, be it
RESOLVED, that the City of Saint Paul Council on behalf of the City of Saint Paul, hereby authorizes the Director of Parks and Recreation or his designee to sign a rental agreement with Macalester University which contains an agreement to indemnify, defend, and hold harmless Macalester University, its officers, employees and contractors from and against any and all claims, damages, losses, and expenses of whatever nature, including attorney fees in any manner connected with, related to, or as a result of any actions or inactions associated with the usage or rental of Macalester University facilities for the purpose of staging the Star of the North Games.
