Clarifying that the Highland Ballfields are exempted from the Ford Site Green Infrastructure Stormwater Management District connection charge.

WHEREAS, the Council of the City of St. Paul, under RES 20-672 established (hereinafter, “District”) and set certain connection, operation and maintenance charges for property and uses served by the District's stormwater infrastructure; and
WHEREAS, when the District was created per RES No. 20-672, certain parcels within the District were expressly described as being outside the District as follows:
“WHEREAS, the Site is generally bounded by Mississippi River Boulevard on the west and south, Ford Parkway to the north, and Cleveland Avenue South to the east, but excludes certain parcels in the general vicinity southwest of the intersection of Ford Parkway and Cleveland Avenue South which are commonly known as parcels presently occupied by Lunds & Byerlys, Target, Highland Village Center, Highland Village Apartments, Cleveland High-Rise.”
WHEREAS, the Council is now advised by the City’s Water Resource Coordinator that the parcel(s) within the District commonly known as the “Highland Ballfields,” while included in the District, were, for District planning purposes, expressly excluded from the District’s initial connection charge calculations under Leg. Code § 81.08.2(a) as the Ballfields, for District planning processes only, were deemed the functional equivalent of City parkland and therefore were excluded from the District’s initial connection charge calculations; and
WHEREAS, the Council, consistent with the initial connection charge planning considerations originally contemplated for the District, as reported by the Water Resource Coordinator, therefore desires to memorialize the consideration to exclude the Ballfields from the District’s connection charge calculations otherwise authorized under Leg. Code § 81.08.2(a), it being further understood however that the Ballfields are obligated to pay the District’...
