Authorizing the Department of Parks and Recreation to enter into a grant agreement, which includes an indemnification clause, for $10,000 in funding from the Capitol Region Watershed District, requiring a five percent in-kind match, to enhance and restore 2.5 acres of native shore land habitat at Loeb Lake.

WHEREAS, the City of Saint Paul is eligible to receive grant funds through the Capitol Region Watershed District (CRWD), Stewardship Grant program; and

WHEREAS, the Saint Paul City Council authorized a resolution allowing the Department of Parks and Recreation to apply for grant funds through the Capitol Region Watershed District (CRWD), Stewardship Grant program; and

WHEREAS, Parks and Recreation has been awarded $10,000 to enhance and restore 2.5 acres of prairie and lake shore habitat adjacent to Loeb Lake within Marydale Park; and

WHEREAS, the grant program requires a five percent in-kind match which will be provided as Parks and Recreation staff time; and

WHEREAS, the habitat improvements must remain fully functional and adequately maintained for a period of ten years. If not maintained through its effective life, the City could be held liable for up to one hundred percent of the grant funds received; and

WHEREAS, the grant agreement requires that the grantee indemnify CRWD, its agents and employees from any claims or causes of action arising from performance of the grant agreement; and

WHEREAS, the Saint Paul City Council finds that accepting these grant funds will allow Parks and Recreation to fulfill ecological principles of habitat restoration; and
