Approving adverse action against the House Sewer Contractor license held by Kober Excavating, Inc. d/b/a Kober Excavating for the City of Saint Paul.

WHEREAS, adverse action was taken against the House Sewer Contractor license held by Kober Excavating, Inc. d/b/a Kober Excavating (License ID #20090001500) for the City of Saint Paul by Notice of Intent to Suspend License dated October 15, 2010, alleging licensee failed to submit a current original License and Permit Bond in the amount of $10,000.00 for the coverage dates of March 28, 2010 to March 28, 2011; and
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required bond information in order to maintain the license; and
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend License to submit the required bond information or request a hearing; and
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to submit the required bond information or request a hearing by October 25, 2010, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the House Sewer Contractor license held by Kober Excavating, Inc. d/b/a Kober Excavating is hereby immediately suspended and the licensee is ordered to pay matrix penalty of $500.00 for failure to submit required bond information in order to maintain the license. Payment of such penalty shall be made within thirty days of the date of the adoption of this resolution.
